BuyAmerica, Inc. d/b/a OfferAway ("OfferAway", "we", "us") operates this website. We are a matching service that connects U.S. homebuyers with licensed real estate attorneys, locally-vetted real estate agents, mortgage specialists, and insurance providers. OfferAway is not a law firm.
2. Information we collect
You give us: name, email address, phone number, approximate home price, state, purchase timing, and anything else you choose to send through our forms or by reaching out to us.
We collect automatically: IP address, device and browser information, pages viewed, referring URLs, and similar usage data via standard server logs, cookies, and lightweight analytics.
3. How we use your information
- Match you with partner attorneys, real estate agents, lenders, and insurance providers based on what you told us.
- Contact you about your purchase via phone, email, and text, including to schedule conversations and answer questions.
- Send service-related updates (e.g., status changes, document requests). You can opt out of marketing emails at any time; transactional messages may continue.
- Operate, secure, and improve our website and services.
- Comply with legal obligations and enforce our terms.
4. Who we share it with
We share what you give us with the partners required to deliver the service you asked for:
- Partner attorneys handling your real estate transaction.
- Locally-vetted real estate agents if you chose OfferAway Agent.
- Lenders we contact on your behalf if you chose OfferAway Mortgage.
- Brightway Insurance and downstream carriers if you chose OfferAway Insurance.
- Service providers who host the site (Vercel), send our email (Resend), and provide analytics. They are bound to use your information only to support our service.
- Authorities if required by law, subpoena, or to protect rights and safety.
We do not sell your personal information.
5. Calls and text messages (TCPA)
When you submit our lead form and check the consent box, you agree that OfferAway and its partners may contact you by phone, text message, and email about your home purchase, including using automated technology. Consent is not a condition of purchasing any service. Message and data rates may apply. You can opt out of texts by replying STOP and opt out of emails using the unsubscribe link.
6. Cookies and analytics
We use cookies and similar technologies for basic site function and aggregated analytics. You can control cookies in your browser settings. Disabling cookies may break parts of the site.
7. Your rights
Depending on where you live, you may have the right to access, correct, delete, or restrict use of the personal information we hold about you, and to opt out of certain processing. California residents have specific rights under the CCPA, including the right to know and to delete. To exercise any right, email us (see Contact below). We will respond within the time required by law.
8. Data retention
We keep your information for as long as needed to provide the service, comply with legal and accounting obligations, and resolve disputes. When no longer needed, we delete or anonymize it.
9. Children
This site is not directed to children under 18 and we do not knowingly collect information from them. If you believe a child has provided us information, contact us and we will delete it.
10. Security
We use reasonable administrative, technical, and physical safeguards. No internet system is fully secure, and we cannot guarantee absolute security of information transmitted to us.
11. Changes to this policy
We may update this policy from time to time. The effective date above will change when we do.
